Dear Chairman Wilson:

Re OSWPCA's plan to replace ~200 'undersized' tanks at homeowner expense.

Improving the quality of Old Saybrook's ground water is not an end in itself. Homeowners can only be forced to pay to upgrade their systems if their current system adversely impacts public health.

In the absence of any proven human health hazard either on or emanating from their specific properties, using the police power of the state against individual property owners is illegal. Property owner wealth cannot be confiscated to mitigate hypothetical health hazards, for there is no end to hypothetical hazards of every kind.

There is no credible mechanism by which people can come into contact with ground water, polluted or not.

If it occurs, pollution of Old Saybrook's beaches is from sewer plant malfunctions upstream on the Connecticut River, or possibly from farming operations upstream on the Oyster River, not from groundwater. There's no way for ground water to 'pollute' Old Saybrook's beaches (or Long Island Sound) without first passing through world's biggest sand filter, the beach itself.

If you have no proof that human health is being harmed by so-called 'ground water pollution,' then you cannot, in law, by your police power, force homeowners to do anything.

The adverse impact on public health, upon which the whole edifice of forcing homeowners to pay for improvements stands, is mere plausibility masquerading as fact.
