Dear Chairman Wilson:

Re Don Lucas's response, i. e., OSWPCA's response, of 21Oct09
to my query letter of 15Oct09 addressed to Pavel Wilson,
OSWPCA chairman, regarding replacing 200 'undersized' tanks.
Lucas's letter is not responsive to my request for scientific
facts, facts that would demonstrate that upgrading so-called
'undersized' tanks would reduce pollution. Coupled with the
fact that you have no evidence that 'undersized' tanks are
contributing to pollution, your program to replace these tanks
is problematical for at least the following additional reasons:
1. Voters cannot nullify the eminent domain law of the
State by establishing a Waste Water Managment District.
'Replacing' (tanks) is just another word for a Summary
Condemnation, via an ex post facto rule, against
homeowners whose property is forfeit as status offenders
merely by being owners of so-called 'undersized' tanks.
This promises to damage 200 owners in the collective
amount of $600,000 without an offer of compensation.
2. There is no CT law that says that 'undersized' tanks must
be brought up to current code every time the Health Dept
increases its recommended specifications.
3. The OSWPCA is unable to provide a guarantee that, if
pollution is reduced anywhere in Old Saybrook as a result
of OSWPCA eminent domain takings, that any remaining
pollution will satisfy a currently non-existent DEP
specification for an 'acceptable level' of pollution.
Let me know when you're ready to open negotiations to buy my
property.
