Re yours of 19Apr13, "Notice of Entry Correspondence."
My letter of 10Apr13 to Commissioner Mullen was indentified
as a query on Exhibit A, not on CRAHD's Notice of Entry
letter; "Re (CRAHD) Connecticut River Area Health
District's form 'Exhibit A.' "
If you are willing to address Exhibit A issues, write again.
29Apr13, CRAHD's Director Jim Monopopli said:
"Specifically, your question is whether Exhibit A,
(as an enclosure with the NOEL letter), is an
approved form by the CT DPH as required in Section
19-13-B103e(c) of the CT Public Health Code.
Exhibit A is clearly labeled an "Application for Initial
Investigation" which places it squarely in the category
of form that requires approval by the Commissioner of DPH.
"The answer to your question is NO."
Whether or not DPH approval of Exhibit A is required by
DPH, Old Saybrook's Article II, Decentralized Wastwater
Management District, Section 173-24(B) requires it.
CRAHD's Monopoli use of Exhibit A, without DPH approval,
which he admits he doesn't have, is in violation of the
Old Saybrook ordinance he's attempting to enforce.
